Privacy policy
This page explains what this website collects, what it deliberately does not collect, what the deadline tool does with what you type (nothing, it stays in your browser), and how to have your information removed. If you would rather not put anything in writing, call us instead.

We know who reads this site. Many of you have a criminal case open right now that came out of the same arrest you want to sue over, and you have every reason to be careful about what you write down and where you write it. So this policy is written plainly, and the short version is this: the deadline tool sends nothing anywhere, we collect the minimum we need to call you back, we never ask for a docket number, a Social Security number or an alien registration number on this website, and you can have your information deleted by sending one email.
The deadline tool
The deadline tool on this site runs entirely in your browser. The page downloads the rule table along with the rest of the page, and everything after that, every date you enter and every agency you pick, is worked out on your own device. Nothing you enter is sent to us, and nothing is stored anywhere: not on our server, not in a cookie, not in your browser's local storage. Reloading the page clears it. Closing the tab clears it.
The "copy summary" button only copies text to your clipboard, so that you can paste it into an email, a note, or the box on our case review form if you choose to. It does not transmit anything.
There is no analytics on the tool page. No script on that page records which agency is chosen, how often the tool is run, or what it shows.
What the case review form collects
The case review form on this site asks for seven things:
- Your name, or whatever name you want us to use
- A way to reach you: a phone number, an email address, or both
- The language you want us to call you in
- What kind of incident it was: an arrest, a use of force, a search, something in a jail or prison, a prosecution, or something else
- Which agency was involved, if you know: the NYPD, another police department, a jail, a state agency, a federal agency
- The date of the incident, so we can tell you how much time there is
- A description in your own words, into which you may paste the summary the deadline tool copied for you
That is all. There is no field for a date of birth, a home address, a Social Security number, a docket number, an officer's name or a family member's information. If you type something into the free-text box, we receive it, so type only what you are comfortable sending.
If you have an open criminal case
Do not describe the arrest in detail in a web form, ours or anyone else's, while a criminal charge from the same incident is pending. Do not name the officers. Tell us the date, the agency and the kind of incident, and tell us the rest by phone or in person. Anything you write online can be requested by the other side later. The criminal case and the civil case page explains why the two cases have to be handled together.
Form submissions are not privileged until you are a client
Attorney-client privilege protects communications with a lawyer who represents you. Sending a web form does not make us your lawyers. Until we and you sign a written retainer agreement, what you send through this site is not a privileged communication. We still treat it as confidential as a matter of professional practice, and we do not share it with anyone outside the firm, but the legal protection of privilege begins with the retainer, not with the form.
Where the form goes
When you submit the form, its contents are sent to the firm's intake email address and stored in our case management system. We use that information to contact you, to run a conflict check, and to evaluate whether we can take the matter. If we do not take the matter, we keep the record only as long as our conflict-checking rules require and then delete it.
What this site does not do
- It does not use advertising cookies, tracking pixels, or third-party analytics on any page.
- It does not sell, rent or share your information with marketers, lead generators or other law firms.
- It does not record your IP address in connection with the form beyond what the email system logs by default.
- It does not use chat widgets or session recording.
The language selector
The language selector at the top of each page uses a translation service that runs in your browser. When you choose a language other than English, your browser requests the translation from that service, which may set its own cookie to remember your choice. We do not receive anything from it. If you would rather it never load, leave the site in English.
Your rights
You can ask us at any time what information we hold about you, ask us to correct it, or ask us to delete it. Email info@usherlegal.com with the name and phone number you used, and we will confirm in writing. If you are a current client, some records must be kept under the rules that govern lawyers, and we will tell you which.
Children
This site is not directed at children, and we do not knowingly collect information from anyone under 18 through it. A claim on behalf of a minor is brought by a parent or guardian, and that person should be the one who contacts us.
Changes
If this policy changes, the date at the top of the page changes with it, and the change is noted here. We do not change it quietly.
